Real estate and construction—confusion and turmoil prevail

As India continues its scorching pace of economic growth, many sectors that were not historically favoured by the government are gaining prominence. One such sector is real estate, which has a large employment generation potential and is a significant source of tax revenue. Additionally, this sector has attracted a large amount of foreign investment in recent times. Therefore, the government would do well to address the many complexities and ambiguities—on the indirect tax front—that the sector is facing.

Historically, the key indirect taxes that applied on the construction and real estate sector were works contract tax (now VAT) and stamp duty. With the expanding service tax net, various construction activities have been brought within the service tax net, notable among them being construction of commercial and residential complexes and renting of immovable property. The latest addition to this list was service tax on works contract, which was introduced in the last budget.

However, the amount of works contract tax payable, under both service tax and VAT, is anything but clear. The Supreme Court, in K Raheja development corporations case in 2006, held that if a developer enters into a contract for sale of a residential apartment before construction is completed, it would be a works contract.

Rare India Partition letters found in Britain

Property agents working on the sale of a house in Gloucestershire have discovered a metal box containing letters dating to the time of Indias partition of the subcontinent, providing a rare insight into the turmoil of those times. The letters, as well as certificates and other memorabilia, were found in a house in Cirencester belonging to a couple who had lived there since 1910. Described as a historic treasure offering a glimpse into country life, the box was found in a wall cavity. Merrill braves crisis with Asia property fund

Merrill Lynch has raised a $2.65 billion (1.5 billion pound) fund to invest in Asian real estate, tapping global investors despite global financial turmoil and falling property markets. Merrills fund is among the biggest to be raised for Asia property this year, though slightly smaller than a $3 billion fund unveiled by LaSalle Investment Management in August and a $3.9 billion fund raised by MGPA, a firm partly owned by Macquarie Bank (MQG.AX: Quote, Profile, Research). Real estate demand to cross 1,000 million sq. ft by 2012

Real estate demand in various segments in the country would cross the 1,000-million sq ft mark by 2012, a real estate investment report said. Indian demand for real estate across office, retail, residential and hospitality sectors is expected to cross 1,000 million sq ft by 2012, said Cushman and Wakefield (C&W) and GRI in The Metamorphosis, a report on India Real Estate Investment for 2008.
